Terms of Service

These Terms govern your use of AirbyteAds (airbyteads.in), a product of Airbyte Technologies. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use AirbyteAds.

1. What AirbyteAds does

AirbyteAds is a software platform that helps you create, manage, and optimize advertising campaigns on Meta platforms (Facebook & Instagram) with the help of AI. You connect your own Meta account, and — with your authorization — the platform performs the actions you request through Meta’s official APIs.

2. Your account

• You must be at least 18 and able to enter a contract.
• You are responsible for your account, your login credentials, and all activity under your account.
• Provide accurate information and keep it up to date.

3. Your Meta connection & responsibilities

• You must own, or be authorized to manage, the Meta ad accounts, Pages, and Instagram accounts you connect.
• You are solely responsible for your ad content, targeting, budgets, and ad spend.
• You must comply with Meta’s Advertising Standards, Platform Terms, Community Standards, and all applicable laws.
• You will not use AirbyteAds to run deceptive, illegal, discriminatory, or prohibited ads or content.

4. Acceptable use

You agree not to:

• violate any law or third-party rights, or Meta’s or any provider’s policies;
• send spam, scams, or misleading content, or abuse messaging/automation features;
• attempt to bypass rate limits, reverse-engineer, disrupt, or gain unauthorized access to the service;
• use the service to access or manage accounts you are not authorized for.

5. AI features

AI features may use your own connected AI provider key. AI outputs are suggestions generated automatically; you are responsible for reviewing and for anything you publish. We do not guarantee that AI output is accurate, compliant, or effective.

6. Plans, payments & billing

• Some features may require a paid plan. Prices and inclusions are shown at sign-up or on the pricing page.
• During the launch period, access may be provided free of charge; we may introduce or change fees with notice.
• Fees (when charged) are billed in advance and are non-refundable except as stated in our Refund & Cancellation Policy. Taxes may apply.
• You are separately responsible for any ad spend you incur on Meta — that is paid directly to Meta, not to us.

7. Intellectual property

AirbyteAds, its software, design, and branding are owned by Airbyte Technologies. You retain ownership of the content you create. You grant us the limited rights needed to store and process your content to provide the service.

8. Third-party services

The service relies on Meta, AI providers, payment processors, and other providers, each governed by their own terms. We are not responsible for third-party services, and access may change if a provider changes its terms or availability.

9. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee any advertising results, reach, revenue, or that the service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Airbyte Technologies will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, ad spend, or data. Our total liability for any claim is limited to the amount you paid us for the service in the 3 months before the claim.

11. Indemnification

You agree to indemnify Airbyte Technologies against claims arising from your content, your ads, your use of the service, or your violation of these Terms or any law or third-party policy.

12. Suspension & termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms, misuse the service, or create risk to us, other users, or Meta.

13. Changes to these Terms

We may update these Terms; we’ll update the “Last updated” date and, for significant changes, notify you. Continued use means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India, and disputes are subject to the courts of India, without regard to conflict-of-law rules.
